Intellectual Property & Business Litigation Attorney
Counsel / Senior Associate · Rosing Pott & Strohbehn LLP — San Diego, CA

Location: San Diego, CA — In-office, full-time (3 out of 5 days/week). This is an in-office position; remote arrangements are not available for this role.

Compensation: $200,000–$240,000 base annually, plus discretionary bonus and full benefits

The Firm

Rosing Pott & Strohbehn LLP is an elite San Diego–based litigation boutique serving clients throughout California and Arizona. Our Business and Intellectual Property Litigation team handles complex, high-stakes federal and state litigation involving trade secrets, defamation, copyright, trademark and contractual disputes, business-ownership and control fights, and TTAB proceedings. Our nationally recognized Professional Liability team defends and advises California and Arizona lawyers — including prominent AmLaw firms — in litigation, arbitration, and State Bar matters. We regularly practice with and against AmLaw 100 firms.

We are a stable, growing firm with exceptional matter volume and expanding client relationships, and we are looking for the right attorney to grow with us.

The Opportunity

This is a true right-hand role, open at the Counsel or Senior Associate level, with opportunity for development to partner. You will work directly and closely with our partners as lead and second chair on sophisticated intellectual property and business litigation matters — owning cases substantively from intake through trial in federal court, state court, and arbitration. We are looking for a confident, self-directed litigator who can take a case and run with it: someone who can be handed a deposition, a dispositive motion, or a trial brief in a complex trade-secret or business dispute and deliver work product at the highest level with minimal supervision.

If you want substantive ownership, real courtroom and deposition experience, direct client contact, and a clear path to partnership at a firm that rewards initiative and results, this role is built for you.

The Work

  • Substantive ownership of cases from pleadings through trial: strategy, written discovery, document review, depositions, motion practice, hearings, and trial.
  • Taking and defending depositions of parties, percipient witnesses, and experts in factually and technically sophisticated matters.
  • Drafting dispositive and substantive motions (motions to dismiss, demurrers, motions for summary judgment, expert/Daubert motions, and oppositions) and persuasive trial and appellate-quality briefs.
  • Litigating sophisticated IP and business disputes: trade-secret misappropriation, business defamation, copyright and trademark disputes, breach of contract, class actions, business-ownership and funding disputes, unfair competition (Bus. & Prof. Code § 17200), and tortious interference.
  • Appearing in federal district court (including the Southern and Central Districts of California), California and Arizona state courts, JAMS and AAA arbitrations, and before the TTAB.
  • Direct client contact and close, day-to-day collaboration with partners.
  • Active trial practice — you will sit at counsel table, examine witnesses, and contribute to firm-wide case strategy.

Qualifications

  • J.D. and current good standing with the California State Bar (Arizona admission, or willingness to seek it, a plus).
  • Admission, or eligibility for prompt admission, to the U.S. District Courts for the Southern and Central Districts of California; additional federal admissions a plus.
  • Substantial complex litigation experience — 5+ years required, with 7–10+ years strongly preferred — including meaningful, hands-on intellectual property and business/commercial litigation experience.
  • A demonstrated track record taking and defending depositions, drafting dispositive motions, and writing trial and appellate-quality briefs in matters involving sophisticated IP and business-law issues.
  • A genuine self-starter who can run cases independently and exercise sound, strategic, and independent judgment while collaborating within a partner-driven team.
  • Excellent legal writing, oral advocacy, organizational, and client-communication skills.
  • A high level of professionalism, judgment, and discretion, and the ability to handle sensitive, high-exposure matters.
  • Comfort working in a cloud-based, modern legal-tech environment (NetDocuments, Clio, etc.).

Compensation & Advancement

  • Base salary 200,000–$240,000, commensurate with experience, plus discretionary bonus.
  • 1,800 billable-hour target.
  • Origination credit for business development.
  • Partnership track: eligibility after 7 years of practice and a minimum of 3 years with the firm; timeline negotiable for lateral hires.

What We Offer

  • A premier boutique environment handling high-stakes, high-exposure IP and business litigation.
  • Substantive ownership and real courtroom, deposition, and trial experience.
  • A collaborative, round-table culture where attorneys work closely with partners to strategize, problem-solve, and craft sophisticated, tailored solutions for clients.
  • A culture built on trust, respect, independence (no micromanagement), integrity, and results — where your expertise is valued and your voice is heard.
  • Personalized professional development, networking, and marketing support.
  • A forward-thinking, technology-driven operational environment.
  • Long-term career potential at a stable, growing firm.

Benefits

  • 401(k)
  • Health, dental, and vision insurance
  • Disability and life insurance
  • Parental leave
  • Paid time off / sick time
